The legal question surrounding Sophie Straat is not just whether one festival call was punishable. The more pointed question is whether artistic and political freedom is a general principle, or is applied more broadly when the message fits within the dominant movement of the moment. If, according to reporting points, 'white men to the back' is not discrimination because of context, intention and artistic-political expression, then the same reasoning must also be seriously tested with an inverted, politically uncomfortable slogan.

Guilty until you can make the opposite plausible?

Suppose someone smokes one pack of cigarettes per day. He wants to drive to Poland once a year and buy his entire annual supply there: 365 packs, about 7,300 cigarettes. There is free movement of goods within the EU and Article 32 of Directive (EU) 2020/262 states that excise goods that a private individual purchases for his own needs and transports to another Member State are in principle only taxed in the country of purchase. However, such a year's supply is not automatically accepted in the Netherlands. Above 800 cigarettes, four cartons of cigarettes, the evidence discussion begins.

Acquittal in the case of 14-year-old Tamar: law of evidence or painful justice gap?

The acquittal of Jamal T. in the case surrounding the death of 14-year-old girl Tamar Boes from Marken is no ordinary crime headline. It is above all a moment of the rule of law: a judge can only condemn what has been legally and convincingly proven, while relatives and the public are left with questions that carry moral weight. One of those questions comes from previous NOS reporting: according to NOS, the driver lived in Germany in July 2020 and was in an asylum procedure at the time. Public sources do not provide clarity about his residence and travel documents on July 25, 2020. It therefore remains unclear on what legal basis he was in the Netherlands that night and on what grounds he drove a car in the Netherlands.
